Terms of Service

1. Introduction

Welcome to Kushi Digital Innovations Ltd ("Kushi", "we", "us", "our"). These Terms of Service ("Terms") govern your use of our website, mobile application, and services (collectively, the "Platform").

By creating an account or using Kushi, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Platform.

Kushi Digital Innovations Ltd is a company registered in Nigeria (RC 9081945) with its registered office at House 1, Three Brothers Street, Ado, Karu, FCT, Nigeria.

2. Nature of Our Services

Kushi is a technology platform that facilitates trust between Landlords and Tenants. We are not a real estate agency, a law firm, or a bank.

  • We provide: Identity verification tools, property listing management, digital tenancy agreement templates, and payment processing integration.
  • We do not: Own, manage, or inspect properties physically (unless explicitly stated as a "Verified by Kushi" premium service). We do not guarantee the condition of any property listed.

3. Account Registration & Eligibility

To use Kushi, you must be at least 18 years old and capable of forming a binding contract.

  • Accuracy: You promise that all information provided (Name, NIN, Phone) is accurate. Using false identities or another person's NIN is a criminal offense and will be reported to the authorities.
  • Security: You are responsible for keeping your password and OTPs confidential. You are liable for all activities that occur under your account.

4. Identity Verification Services

We use third-party government APIs (NIMC/NIBSS) to verify user identities.

  • Consent: By using these features, you authorize us to query your data against government databases.
  • Limitation: While we strive for accuracy, verification is based on available government records. Kushi does not guarantee that a verified user is incapable of fraud. You should always exercise due diligence.

5. Property Listings & Landlord Obligations

If you list a property as a Landlord:

  • Ownership: You represent that you have the legal right to lease the property (e.g., you are the owner or a deeply authorized attorney).
  • Accuracy: Your photos and descriptions must truthfully reflect the property's condition. "Catfishing" (using fake photos) will result in an immediate ban.
  • Scams: Any attempt to solicit payments outside the Kushi Platform to avoid verification is prohibited and is a breach of these Terms.

6. Payments & Fees

  • Service Charge: Kushi charges a service fee (displayed at checkout) for facilitating the transaction and verification. This fee is generally non-refundable.
  • Rent Processing: Rent payments are processed via licensed payment gateways (e.g., Paystack). Kushi does not hold your funds indefinitely; they are routed to the Landlord according to the payout schedule defined in the app.
  • Refunds:
    • If a Tenant pays for a property that does not exist or was misrepresented, Kushi will facilitate a refund investigation.
    • If a Tenant changes their mind after signing the agreement, refunds are subject to the specific cancellation policy set by the Landlord.

7. Digital Tenancy Agreements

We provide standard templates for Tenancy Agreements.

  • Not Legal Advice: These templates are for convenience. We recommend seeking independent legal advice for complex leases.
  • Binding Nature: Once digitally signed by both parties on our Platform, the agreement is legally binding under the Nigerian Evidence Act 2011.

8. Prohibited Activities

You agree not to:

  • Use the Platform for money laundering or illegal financial flows.
  • Harass, abuse, or discriminate against other users.
  • Reverse engineer, decompile, or attempt to hack the Kushi application.
  • Post false, misleading, or fraudulent content.

9. Limitation of Liability

To the fullest extent permitted by Nigerian law:

  • Kushi is not liable for any direct, indirect, or consequential damages arising from your use of the Platform.
  • We are not liable for disputes between Landlords and Tenants (e.g., property damage, unpaid rent, eviction issues). We provide the tools for the agreement, but we are not a party to the agreement itself.
  • Our total liability for any claim shall not exceed the amount of Service Fees you paid to Kushi in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Kushi, its directors, and employees from any claims, damages, or legal fees arising from your violation of these Terms or your infringement of any third-party rights.

11. Dispute Resolution

  • Amicable Settlement: In the event of a dispute, you agree to contact Kushi Support first to attempt an informal resolution.
  • Arbitration: If unresolved, the dispute shall be referred to Arbitration in Abuja, Nigeria, in accordance with the Arbitration and Conciliation Act. The language of arbitration shall be English.
  • Jurisdiction: These Terms are governed by the laws of the Federal Republic of Nigeria.
